Terms of Service

These Terms of Service ("Terms") govern your use of CinePrecise, an iOS application ("the App") developed and distributed by TRISIMIO SL (CIF B06916753), a company registered in Madrid, Spain, trading under the Trimonkey brand ("we", "us", "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on any Apple device you own or control, subject to the Apple Media Services Terms and Conditions and these Terms.

You may not:

– Copy, modify, or distribute the App or any portion of it
– Reverse-engineer, decompile, or disassemble the App
– Rent, lease, or lend the App to third parties
– Use the App for any unlawful purpose

2. Intellectual property

The App, including its code, design, visual assets, camera database content, and all associated intellectual property, is owned by TRISIMIO SL or its licensors. All rights are reserved. Nothing in these Terms grants you any right to our trademarks, logos, or brand features.

3. In-app purchases and subscriptions

CinePrecise may offer optional paid features, one-time purchases, or auto-renewing subscriptions ("Premium"). All purchases are processed by Apple through the App Store.

– Auto-renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
– Cancellation: Manage or cancel subscriptions in your Apple ID account settings.
– Refunds: All refund requests are governed by Apple's refund policy. We cannot issue refunds directly. Contact Apple at reportaproblem.apple.com.
– Restore purchases: Use the "Restore Purchases" button in the App's settings to reinstate any prior purchases on a new device.

4. Accuracy of data

The camera database, depth of field calculations, exposure calculations, and sun position data provided by the App are intended as professional reference tools. While we strive for accuracy, all values are provided "as is" without warranty of fitness for a particular purpose. Always verify critical measurements independently on professional productions.

5. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

6. Limitation of liability

To the maximum extent permitted by applicable law, TRISIMIO SL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.

7. Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. The App is designed to process all data on-device. We do not collect personal data through the App.

8. Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice. We may update these Terms periodically. Continued use of the App after changes are published constitutes acceptance of the revised Terms. Material changes will be communicated via an App Store update notice or within the App.

9. Third-party services

The App may link to third-party websites or services (e.g., Apple's App Store). We are not responsible for the content, privacy practices, or terms of any third-party services.

10. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain, except where mandatory consumer protection laws in your country of residence provide otherwise.

If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

11. Termination

These Terms remain in effect until terminated by you or us. Your rights under these Terms terminate automatically if you fail to comply with any provision. On termination, you must cease all use of the App and delete it from your devices.

12. Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and TRISIMIO SL with respect to the App and supersede all prior agreements and understandings.
